§ 74-27. Rules for sales.

  • (a)

    All temporary sales, including garage sales, yard sales or other sales shall comply with this article.

    (b)

    All such sales shall be held for no more than three days.

    (c)

    No more than two such sales shall be conducted on any location or address during a 12-month period. The 12-month period shall be from the date of the first such sale at the location.

    (d)

    No more than two signs shall be posted on any residential property advertising such sales, and no sign shall exceed four square feet in size.

    (e)

    All persons shall comply with the following requirements:

    (1)

    No person shall hold himself out as habitually engaging in the business of selling tangible personal property at retail.

    (2)

    No person shall carry on such sale in such a manner as to create a disturbance or become a nuisance to the neighborhood.

    (3)

    Only personal property that belongs to such person personally which has not been purchased for purpose of resale shall be exhibited.

    (4)

    The person conducting such sale shall clean the immediate area of the temporary sale, including public streets and rights-of-way, of any and all trash, paper, etc., upon the end of the sale or expiration of the permit. If a person fails to remove all trash, paper, etc., the city will do so, and the person must pay the actual costs incurred by the city to clean the area and/or remove the trash, paper, etc.
